TERMS AND CONDITIONS Belcanto Villas
The www.BelcantoVillas.com website (the "Website") is owned by Belcanto Srl company registered in Italy, Vat number 07352310481 with registered office in Florence 50125 (Fi), via Romana, 29, (hereinafter called "B.V."). These General Terms and Conditions govern the use of the Website www.BelcantoVillas.com by users and constitute a binding agreement between B.V. and the individual user ("User"). By accessing and using any of the services on this website, you become a user of its services. By accessing the Website and using specific services, the user automatically accepts and complies with the Terms and Conditions associated with all available services. Accessing this website implies that you have recognized and accepted its Terms. Users, who do not agree to be bound by these Terms, must promptly discontinue their use of the Website.
1) FEATURES AND SERVICES OF THE WEBSITE
The Website presents properties ("Properties"), for which contracts can be entered into with B.V. authorised to offer them for rent or for stay use. The Website also offers Users the opportunity to purchase ancillary services offered by third parties, including, by way of example but not limited to, the cleaning of the property, as well as other services to be provided upon request. Users can purchase additional ancillary services in relation to rental or stay use through the same procedure, while signing the rental or stay use contract.
2) RENTALS OR ACCOMMODATION USE
B.V. is authorised to act as a booking agent to negotiate rentals and accommodation on behalf of property owners. Some properties may have a minimum rental period or a specific day of the week as an arrival (e.g. Saturday). This information is mentioned in the price list.
In the case of property rentals in Italy, it is mandatory for Italian law to sign a rental contract, and if the duration is more than 30 nights, this rental contract must be drawn up in Italian (a copy in English can be requested) and must be paid (both by the landlord and the tenant customer) half of the registration tax of 2% calculated on the rental amount, plus € 30 of revenue stamps (with a minimum of € 67). This cost can be avoided depending on the fiscal choices of the landlords, and if the tenant customer is not a company.
3) RENTAL OR ACCOMMODATION PRICES
The rental or accommodation prices are per unit and per period (different per season). All additional costs (mentioned in the description of each property as not included in the rental or accommodation price) must be paid directly to the property owner or his representative upon arrival at the property, unless otherwise agreed in writing at the time of booking . Prices are an integral part of these general conditions.
3A) MINIMUM PRICE GUARANTEED B.V.
B.V. guarantees that the prices published through the "Website" are the lowest available on the market. If customers find (for the same property, the same dates, under the same conditions, and for rates in euros) a lower price with a competing agency, the customer will be entitled to a discount from B.V. equal to the difference between the prices released by B.V. and those published by the competing agency. The only exception is a difference of less than or equal to 50 € overall on the published prices (always referring to the conditions mentioned above).
4) HOW TO BOOK
All reservations must be made directly through B.V. or agencies authorized to act on behalf of B.V. These agencies may also accept payments from the client on behalf of B.V. The client must complete the booking form and accept these general conditions.
At the time of booking confirmation, a deposit of 30% of the total amount is required (unless otherwise specified). The balance is due no later than 45 days prior to arrival at the property. If the balance is not paid within this time limit, B.V. reserves the right to cancel the booking. Full payment is required for bookings confirmed less than 45 days prior to arrival. Any exceptions to the above payment terms are mentioned in the property description.
Upon receipt of the balance B.V. will provide the customer with an accommodation voucher with the address and directions to reach the property and instructions for accessing it.
Upon arrival the client must show the voucher to the owner of the property or his representative, before gaining access to the property. No other documents will be accepted. The voucher is personal and valid only for the persons indicated in the booking form and is not transferable. The owner or his representative will refuse entry to the property if the number of people exceeds the number indicated on the voucher. In the event of a change in the total number of people during the stay, B.V. must be informed in advance, otherwise the owner or his representative may ask the whole group of clients to leave, in which case the client will not be entitled to any refund of the rent or associated expenses.
All changes and special requests must be agreed in advance with B.V. Children under the age of 2 (two) years can stay at the property for free and are not counted in the number of people booked for the stay at the property, provided that the customer brings his own cot and linen (any exceptions to the description of the property are reported).
5) PAYMENT
Payments must be made by bank transfer (SWIFT) or credit card (VISA, MASTERCARD or AMERICAN EXPRESS). For payments made by bank transfer it is necessary to clearly specify the client's name, the reservation number and the reference of the property. For properties located in the European Union and in other countries where the Euro is the official currency (currently Andorra, Monaco, San Marino and Vatican City), payments in currencies other than the Euro (€) are not accepted.
6) ARRIVAL AND DEPARTURE
Unless otherwise specified in the description of the property, the customer must arrive at the property between 4.00 pm. and 7.00 pm. Any changes to the arrival times must be communicated to B.V. well in advance before arrival during normal office hours (Monday to Friday from 9.00 am. to 1.00 pm. and from 2.00 pm. to 6.00 pm. and from Easter to October also on Saturdays from 4.00 pm. to 8.00 pm.) and are subject to the approval of the property owner.
In case of unexpected late arrival, the customer must notify B.V. and also the owner directly. If the owner or his representative is unable to accept a late arrival, all associated costs incurred by the customer (including without limitation) hotels, restaurants, travel are the responsibility of the customer. If the owner or his representative is obliged to wait for customers after the agreed time, he can request a penalty for late arrival.
Upon arrival, the customer must present the accommodation voucher and the identity documents or passports (if necessary) of all members of the group to the owner or his representative in order to comply with Italian law. Only guests whose identity documents or passports are registered can stay on the property. In case of replacement of people during the stay, the owner or his representative can ask the whole party to leave, in which case the customer will not be entitled to any refund or compensation. In addition, any additional costs including local tourist taxes (where required) may be deducted from the security deposit.
Unless otherwise specified in the description of the property, to allow the cleaning services, all customers must leave (and leave the property empty from their objects) between 8.00 am. and 10.00 am., after returning the keys to the property and allowing the owner or his representative to check the condition of the property.
7) REFUNDABLE SECURITY DEPOSIT
Upon arrival (unless otherwise indicated in the property description) the customer must pay a security deposit to cover any damage or extra expenses not included in the rental or accommodation price.
The security deposit is to be paid to the owner or his representative in euros (€) and in cash (unless otherwise indicated) as per the amount indicated on the voucher. The owner or his representative has the right to refuse entry to the property if the security deposit is not paid, in which case the client will not be entitled to any refund or compensation. The security deposit will be returned to the client on departure minus any damage or extra expenses not included in the rental or accommodation price. If the amount of any damage is greater than the security deposit, customers must pay the difference to the owner or his representative before departure. If in the property description it is indicated that the security deposit must be paid to B.V. (instead of to the owner on site), payment by bank transfer must be made at least 4 working days before arrival, to allow verification and communication to the owner. In this case, the security deposit will be returned by bank transfer, net of any damage or extra expenses not included in the rental or accommodation price, within 7 days after departure, after the owner has checked and communicated any damage.
B.V. is not responsible for any disputes between the customer and the owner regarding the security deposit, but is always available to settle any dispute.
8) CLEANING AND MAINTENANCE
The property will be in perfect condition at check-in, with all equipment in working order (the customer has 18 hours to report any anomalies in writing) and must be returned in the same condition at the time of check-out, except for normal wear and tear of use. We do not require customers to wash the linen or clean the property at the time of check out, but to take care of the property, remove waste, food from the refrigerator and take care to leave the property in good condition, order, maintenance and cleaning.
In the event that at the time of cleaning, the property is found in particularly dirty conditions, or damage is found not present at the time of check-out, the tenants will be charged, and deducted from the security deposit, the damages and the amount of Euro 18.00 for each hour of extra cleaning required. The cost of damages will be provided within 7 days of check out.
9) UTILITIES
Utilities (Internet connection, water, gas for hot water and heating, electricity and air conditioning if applicable) are mentioned if included or not in the property description and in the price list. If it is not clearly indicated that utilities are included in the Price, the related costs must be paid locally to the owner or his representative and can be calculated according to consumption or a flat rate.
In Italy, the use of heating (period of use, temperature…) varies from region to region. Currently in Tuscany the use of heating is allowed in the period from November 1st to March 30th for 8 hours a day. The possibility of using the heating outside this period, and the relative cost, must be agreed with the owner of the leased property because they could be sanctioned by the Italian institutions. Properties where heating is not indicated do not have a heating system.
10) PETS
Pets (dogs and cats) are allowed only in properties that indicate pets are accepted. At the time of booking confirmation, the customer must notify B.V. of any pet (indicating size and breed) so that B.V. can inform the owner. Any supplement that the owner may request for the acceptance of a pet will be mentioned in the property description and must be paid locally. The customer must take care of their pet in order to avoid possible damage or disturbances.
11) BEHAVIOR
The customer who rents a B.V. property is responsible for his correct behavior during the occupation of the property. If a client does not behave in a civil and dignified manner, the owner or his representative has the right to ask the client and his group to leave the property immediately and can deduct from the security deposit the sums necessary to repair any damage and cover the related costs. In these circumstances, the customer will not be entitled to any reimbursement of the rent or associated expenses.
If the amount of any damage is greater than the security deposit, customers must pay the difference to the owner or his representative before departure.
IMPORTANT: It is absolutely forbidden to access (for any reason) the leased property with a number of guests exceeding the maximum capacity of the property. It is also strictly forbidden to organize parties, birthdays or events in general without the owner's consent.
12) EXTERNAL MAINTENANCE
The owner or his representative reserves the right to enter the property (even independent villas) for essential maintenance works: garden, swimming pool ...
13) INSURANCE
Properties have real estate insurance that does not cover any damage that the customer can do, or any injuries to them. A personal insurance coverage is recommended for the duration of the booking.
14) CLAIM
The description of the properties is made in good faith. and B.V. cannot be held responsible for changes made by the owner of the property without notice.
If the client has any complaints in the property, he must inform B.V. on the day of arrival and confirm it in writing (reservations@BelcantoVillas.com) within 18 hours: B.V. office is open from Monday to Friday from 9.00 am. to 1.00 pm. and from 2.00 pm. to 6.00 pm. and from Easter to October also on Saturdays from 4.00 pm. to 8.00 pm.
No complaints will be accepted if this procedure is not followed.
B.V. reserves the right to verify, during the period of occupation, the reasons for the customer's complaint, if necessary by inspecting the property. If the complaint is accepted, the customer will be compensated in proportion to the damage suffered (up to a maximum of the rental or accommodation price).
If necessary, B.V. reserves the right to move the client to a similar or better property, based on availability. If the price of the accommodation in the alternative property is lower than the price of the accommodation in the booked property, B.V. will refund the customer the difference between the price paid and the price of the accommodation in the alternative property.
If the price of the accommodation in the alternative property is higher than the price of the accommodation in the booked property, the difference will not be charged to the client. If the customer accepts this exchange, no further compensation will be due to the customer.
If no alternative property is available, B.V. will reimburse the customer in proportion to the damage suffered (up to a maximum of the rental or accommodation price). In no event B.V. will pay or be responsible for any costs of hotel or other accommodation stays.
If a customer leaves a property without giving B.V. the chance to verify the reason for the complaint, the customer loses the right to any compensation or refund. If a customer complains when he is no longer on the rented property or accommodation, he loses the right to any compensation or refund.
B.V. will not accept weather conditions, bites or the presence of insects, lack of utilities (internet, water, electricity, gas and heating), works in progress, etc., and other conditions that do not depend on B.V. or by the owner of the property.
The properties promoted by B.V. are not hotels but private homes (in some cases hotel-like accommodation). Their equipment, furnishings and features reflect the local style, the taste of the owner and local traditions (e.g. in Italy the coffee machine is often the Italian moka and not the electric or Nespresso machine) and do not reflect the standard classification (stars) used from hotels. Therefore, B.V. does not consider these elements as grounds for complaints.
15) CANCELLATION
In case the customer cancels their reservation, the following cancellation charges will be applied:

Any exceptions to the cancellation policy are mentioned in the property description.
If B.V. was forced to cancel a booking for reasons beyond its control, B.V. will offer, subject to availability, a similar or better property.
If the price of the accommodation in the alternative property is lower than the price of the accommodation in the booked property, B.V. will refund the customer the difference between the price paid and the price of the accommodation in the alternative property.
If the price of the accommodation in the alternative property is higher than the price of the accommodation in the booked property, the difference will not be charged to the client.
If no alternative property is available, B.V. will refund the customer the total amount paid for the rental or accommodation and no further compensation will be due to the customer.
16) INTELLECTUAL PROPERTY
All contents published on the Website - or accessible through it - are protected by copyright and industrial property legislation. Users are not authorised to reproduce, modify, decode, copy and disseminate the information and contents referred to above without the express prior consent of B.V.
17) JURISDICTION
These terms and conditions are governed by the law of the Country where the property is. Any dispute arising from these Terms & Conditions, any booking and / or use of the Website by Users will be subject to the exclusive jurisdiction of the Court of Florence, Italy.
18) DATA PROTECTION
B.V. may use your personal data (as defined by the Data Protection Act 1998) for the purpose of processing bookings and providing services, customer identity and verification, file and record administration, legal and regulatory compliance, and marketing and promotion of services, as well as to inform customers of relevant news.
Please note that we will need to share information with property owners as part of the booking process. You have the right to access the personal data we hold about you. If you do not want us to process your personal data for marketing purposes, please notify us in writing as soon as possible. All data sent to the Website are treated in accordance with our Privacy Policy, accessible in the Privacy section of the Website.
